REGULATIONS OF THE ‘MAZURY AIRPORT B2B’ PROGRAM FOR TRAVEL AGENTS

  1. Definitions

1.1.

Warmia i Mazury Sp. z o.o. – managing entity (PL Olsztyn – Mazury) with the registered office in Szymany 150, 12-100 Szczytno

Program – a program supporting the sale of airline tickets departing from PL Olsztyn – Mazury. ‘Mazury Airport B2B’, addressed to travel agents, regulated in these Regulations

Charter flight – an operation without regular status, departing from PL Olsztyn – Mazury. Flights are made pursuant to the air charter agreement where the air carrier makes a specific number of seats or capacity of the aircraft available to the charterer in order to carry out a specific transport of passengers, luggage, goods or mail, indicated by the charterer

Agent – stationary, tourist agency selling airline tickets

Passenger – a person travelling on a regular or charter flight from PL Olsztyn–Mazury

Tourist destination – air destinations from PL Olsztyn -Mazury. In the 2019 summer season, the tourist destination is connection to Burgas

Monthly report – a summary of the number of tickets sold by the Agent for the sale of offers with departure from PL Olsztyn-Mazury

Working days – from Monday to Friday, excluding public holidays

Force majeure – circumstances beyond the control of PL Olsztyn-Mazury, tour operator, airline, Agent, passenger or other factors due to which there will be no air operation or departure of the passenger from PL Olsztyn-Mazury

  1. General provisions

2.1. The ‘Mazury Airport B2B’ program allows the Agent to receive a commission for the sale of airline tickets departing from PL Olsztyn-Mazury in tourist directions. An agent operating in Poland pursuant to the 29 August 1997 Act on tourist services, selling air tickets via reservation systems and/or carriers’ websites may become a Program participant. The 1st (first) edition of the program is valid from 1 November 2018 to 1 September 2019.

  1. Participation in the Program

3.1. The condition of participation in the Program is:-

3 Joining the group of the program participants is connected with the necessity to sign a commission agreement, acceptance of the program regulations and following the instructions for participants.

3.8. The Agent is obliged to promote the offer of charter flights from PL Olsztyn-Mazury by displaying the materials provided by PL Olsztyn-Mazury in a place visible to the office’s clients, which means: Placement of the Program’s advertising sticker on the office’s website; Displaying promotional and informational materials of the Program in the office, with particular emphasis on the information leaflets with the display; An exhibition of roll-up media presenting a network of connections to the outlet from PL Olsztyn-Mazury that  PL Olsztyn-Mazury will send at least once every two weeks via e-mail to the address provided by the Agent; The Agent is obliged to maintain this exhibition throughout the duration of the Program in good order and condition;

3.9. In the event of destruction of materials or exhaustion of their circulation figure, the Agent is obliged to notify PL Olsztyn-Mazury, PL Olsztyn-Mazury is not responsible for delays in the delivery of promotional materials caused by a courier or another delivery company;

4.1. In exchange for the sale of airline (charter) tickets departing from PL Olsztyn-Mazur, the program participant receives a commission on the sale. The commission amount is 5% net of gross sales value. The commission is calculated and paid on a monthly basis. Its verification is based on sales data (booking numbers) entered into the form and sent to the e-mail address PL Olsztyn-Mazury mentioned in the commission agreement. Payments of commission due will be made by bank transfer to the account number indicated in the commission contract.

4.2. The sales report should be sent to the e-mail address provided by the 14th day of the following month. Payment of commission receivables will be made within 21 days of the above date.

4.3. The commission privilege applies only to transactions carried out and transactions for individual recipients, applies to published, restrictive (non-returnable) rates on the carrier’s website, in the Merlin X distribution system or other ticket systems.

4.4. In the event of cancellation of the flight due to reasons beyond the control of the parties, the commission paid for the sale of tickets for a cancelled flight shall be refunded to the Organiser’s account (provided in the commission agreement).

4.5. The commission privilege cannot be combined with group rates and other unpublished rates.

4.6. PL Olsztyn-Mazury reserves the right to grant additional gratuities or prizes and material bonuses related to the promotion of specific destinations, departure dates, offers, regions in any configuration. Information on the possibility of additional gratification will be sent to Agents via e-mail each time.

4.7 The program partner is additionally entitled to a pool of 5 vouchers for a free 7-day parking of one passenger car each, to be used in PL Olsztyn-Mazury and for the benefit of the office’s clients. The validity period of each voucher is 4 September 2019.

4.8. The name of the program partner with a brief description and reference to the partner’s home page (always to the tab presenting tourist products at the beginning of the journey in PL Olsztyn-Mazury) will be placed in the catalogue of the program participants on the Organiser’s website in the ‘B2B’ tab.

  1. Withdrawal from the Program

5.1. The Agent has the right to withdraw from participation in the Program at any time by sending information by e-mail to the address mentioned in the commission contract.

5.26. Violation of the Program Regulations

6.1. If PL Olsztyn-Mazury detects activities that violate these Regulations, acts to the detriment of PL Olsztyn-Mazury or affect its image, the Agent will be asked to explain the situation within 3 business days in writing or electronically;

  1. Completion of the Program

7.1. PL Olsztyn- azury reserves the right to suspend or terminate the Program at any time during its duration. PL Olsztyn-Mazury is obliged to send information electronically to Agents participating in the Program.

  1. Amendments to the Regulations

8.1. PL Olsztyn-Mazury reserves the right to amend these Regulations, including the method and number of points awarded, at any time during the Program. In the event of changes to these Regulations PL Olsztyn-Mazury will make the amended Regulations available on the Program website and send via electronic mail to Agents participating in the Program.

  1. Final provisions

10.1. The data collected through the registration form will be used by PL Olsztyn-Mazury only for purposes related to the Program and implementation of the provisions of the Regulations. The agent has the right to inspect his data and update it. Upon joining the program, the Agent is obliged to accept the provisions of these Regulations under pain of no positive verification. By joining the Program, the Agent agrees for PL Olsztyn-Mazury to send advertising content related to the Program or Program Partners to the e-mail address provided during registration. All correspondence related to the Program should be directed to: Warmia i Mazury Sp. z o.o., Szymany 150, 12 – 100 Szczytno.

  1. GDPR

11.1. The controller of the participants’ personal data is Warmia i Mazury Sp. z o.o., Szymany 150, 12-100 Szczytno, NIP [Tax Identification Number:] PL-7451842294 • REGON [Central Registry Business Number:] 281345971 • KRS [National Court Register:] 0000399439. Data can be profiled in particular for marketing purposes, conducting research, assessing shopping interests and preferences, including offering and presenting advertisements, products and services based on assigned preferences as well as for internal analysis. The data is stored for the period necessary to conduct the activities arising from the services provided. The following categories of data will be used for profiling: information about products and services, manner of their usage, information about payments, information included in the cookies, information about electronic addresses (visited subpages), information about the used devices. Warmia i Mazury Sp. o.o. uses the above-mentioned information to assess preferences and interests.

The program participant has the right to object to profiling its activities at any time for the purposes of direct marketing. Please, be advised that opposition to direct marketing will be tantamount to withdrawal of consent to profiling.

In order to provide services properly, personal data may be shared with trusted business partners.

Each program participant has the right to:

– access to your personal data, rectification, deletion or limitation of processing and updating,

– to object to further processing.

The exercise of the right to withdraw consent does not affect the processing that took place until the consent was withdrawn. From 25 May 2018, each program participant also has:

– the right to lodge a complaint to the supervisory body

– transfer the data

– the right to ‘be forgotten’
